1. Who we are and who these terms apply to
L'Escapade is a two-bedroom residence at The St. Regis Saadiyat Island, Abu Dhabi, operated by Gulf Spirit and Vibes GSV Vacation Home Rental L.L.C S.P.C, Abu Dhabi, United Arab Emirates (Commercial Licence No. CN-4953789, Commercial Registry No. 5969888, Holiday Home Permit No. PER25000479).
These terms apply when you book directly with us, by WhatsApp on +971 50 541 3369, by email at lescapade@gulfsv.com, or by telephone. If you book through Airbnb or Booking.com, your stay is governed by the terms, cancellation policy, and payment terms of that platform, and those terms apply instead of these.
2. Booking and confirmation
A booking is a request until we confirm it in writing. Your reservation is confirmed once we have acknowledged your dates in writing and received the deposit described below. We will then send you a written confirmation with your arrival details.
Direct bookings are confirmed once a deposit of at least 50% of the total amount due for the booking is received.
3. Rates and payment
Rates are quoted per night in UAE Dirhams (AED) and confirmed at the time of booking. The quoted rate includes utilities, Wi-Fi, St Regis facilities access, and appropriate discounts, and excludes the six (6) percent Abu Dhabi tourism fee. A checkout cleaning fee of AED 450 is payable at the time of booking.
To confirm a booking we ask for a deposit of 50 percent of the total booking fee. The balance is due 30 days before arrival, or in full at booking for stays within 30 days.
We accept payment by bank transfer or by credit or debit card.
Mandatory Tourism Fee and VAT. A mandatory Abu Dhabi Tourism Fee of 6% applies to all bookings and is collected on behalf of the Department of Culture and Tourism – Abu Dhabi (DCT Abu Dhabi). VAT will be charged only where applicable and required by UAE law. No other mandatory fees are charged unless expressly disclosed at the time of booking.
4. Security deposit and damage
A refundable security deposit of AED 1,500 is taken before arrival and returned within 5 business days of departure, less the cost of any damage or missing items.
You are responsible for the residence and its contents during your stay. We will tell you promptly of any damage or loss beyond fair wear and tear, with supporting detail, before any deduction is made.
5. Changes and cancellation by you
If you need to change or cancel a confirmed booking, the following applies.
- Cancellation more than 42 days before arrival: 100% refund.
- Cancellation between 42 and 30 days before arrival: 50% refund.
- Cancellation within 29 days of arrival, or no-show: no refund.
- Date changes are subject to availability and may affect the rate.
6. Cancellation by us
We do not expect to cancel a confirmed booking. If we must, for reasons within our control, we will offer you alternative dates or a full refund of all sums paid.
Force Majeure. If a stay cannot proceed due to circumstances beyond our reasonable control, including natural disasters, government actions, war, civil unrest, epidemics, utility failures, or other force majeure events, neither party shall be liable for any resulting delay or cancellation. Where the Property is unavailable as a direct result of such an event, the Guest shall be entitled to a refund of any prepaid accommodation charges for nights not provided. Our liability shall not exceed the amount paid for the affected booking.
7. Arrival and departure
Check-in is from 15:00 hours and check-out is by 11:00 hours. Early check-in and late check-out can be arranged on request at no extra charge, subject to availability. We will share access and arrival instructions with you before your stay.
8. Who may stay
The residence sleeps six (6) guests and may not be occupied by more than that number without our written agreement. The booking is for the named guests only. The residence may not be used for parties, events, or commercial filming.
Guest Identification and Registration. All Guests must provide valid government-issued identification (including passport, Emirates ID) prior to check-in. We collect, use and, where required, share this information with relevant authorities to comply with applicable laws, regulations and holiday-home licensing requirements. Such information will be retained and processed in accordance with our Privacy and Cookies Policy.
9. House rules
To protect your comfort, the residence, and our standing with the St Regis and the building, we ask that you observe the following.
- Smoking and vaping are not permitted indoors.
- Pets are not permitted.
- Quiet hours apply between 22:00 hours and 06:00 hours.
- The St Regis facilities and their rules apply to all guests.
- No additional overnight visitors beyond the named party without our agreement.
10. Your responsibilities
You agree to treat the residence and its contents with care, to comply with the building and St Regis rules, to respect other residents, and to report any issue or damage to us promptly. You are responsible for the conduct of everyone in your party.
11. Our responsibilities and liability
We will provide the residence in clean, safe, and working order, and we will deal with any issue during your stay promptly and in good faith.
Limitation of Liability. To the fullest extent permitted by law, we shall not be liable for any loss, damage or expense arising from circumstances beyond our reasonable control, and our total liability shall not exceed the amount paid for the relevant booking; however, nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under UAE law.
12. Your data
We handle your personal data in line with our Privacy and Cookies policy. In short, we use the details you give us to manage your booking and stay and to meet our legal obligations as a licensed holiday home, and we do not sell or share your data for marketing.
13. Governing law and disputes
These Terms shall be governed by and construed in accordance with the laws of the Emirate of Abu Dhabi and the applicable federal laws of the UAE, and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, without prejudice to any rights or remedies that may not lawfully be excluded or restricted under applicable law.
